The Council of Ministers of Burkina Faso met on Wednesday, November 8, 2023, in its regular session, under the chairmanship of His Excellency Captain Ibrahim TRAORE, President of the Transition, President of the Council of Ministers. It deliberated on the items on its agenda, heard oral communications, made appointments, and authorized foreign missions.

I. DELIBERATIONS

I.1. UNDER THE MINISTRY OF ECONOMY, FINANCE, AND PROSPECTIVE

The Council adopted a decree establishing the creation, attributions, composition, organization, and functioning of a Fiscal Policy Committee. This decree is a revision of decree n°2010-395/PRES/PM/MEF of July 29, 2010, establishing the creation, attributions, composition, organization, and functioning of a Fiscal Policy Committee.

The innovations of this decree include:

  • the reformulation of attributions to take into account certain changes (state program budget and ECOWAS fiscal transition program) and to consider the evaluation of the impacts of implemented fiscal and customs reforms;
  • the organization of the Fiscal Policy Committee (CPF) into two (02) bodies: a body of orientation and decision-making composed of the statutory members of the CPF and an administrative and technical execution body, the Permanent Secretariat of the Fiscal Policy Committee (SP-CPF);
  • the introduction of a maximum duration per session (03 days), a quorum for deliberation (2/3), and a minimum deadline for members to examine documents before the effective holding of sessions.

The adoption of this decree will enable the Fiscal Policy Committee to effectively fulfill its missions, in accordance with the provisions of decree n°2023-0198/PRES-TRANS/PM/MEFP of March 13, 2023, organizing the Ministry of Economy, Finance, and Prospective.

I.2. UNDER THE MINISTRY OF ENERGY, MINES, AND QUARRIES

The Council adopted a report on four (04) decrees.

These are:

  • the decree revoking the industrial exploitation permit for the Perkoa zinc mine of the company Nantou Mining Burkina Faso SA, in the province of Sanguié, Centre-Ouest region;
  • the decree revoking the industrial exploitation permit for the Yéou gold mine of the company NORDGOLD YEOU SA, in the commune of Bouroum, Namentenga province, Centre-Nord region;
  • the decree revoking the small-scale gold mining permit of the company KOMET RESSOURCES AFRIQUE SA, in the communes of Guiro and Diouga, Namentenga and Séno provinces, Centre-Nord and Sahel regions;
  • the decree revoking the industrial exploitation permit for the Kalsaka gold mine of the company BALADJI GROUP MINING KALSAKA (BGMK) SA, in the commune of Kalsaka, Yatenga province, North region.

Concerning Nantou Mining Burkina Faso SA, it is in judicial liquidation and does not have significant financial resources to resume the activities of the Perkoa zinc mine.

For NORDGOLD YEOU SA, its permit has expired since March 13, 2020, and it has not been able to provide a complete file for renewal, in accordance with the regulations.

For KOMET RESSOURCES AFRIQUE SA, it has operated the mining without authorization from the mining administration for more than two (02) years. Furthermore, mining taxes and royalties have not been paid since the acquisition of the permit by assignment in 2015. Moreover, in 2022, it was involved in gold marketing fraud.

As for BALADJI GROUP MINING KALSAKA (BGMK) SA, it has operated the mining without authorization from the mining administration for more than two (02) years. Having been placed on notice, it has been unable to justify its technical and financial capacities to continue the operations.

The revocation of these permits will allow the State to seek new investors for the continuation of mining activities and to promote economic revival in these areas.

The Council decided to revoke the exploitation permits of these mining companies, in accordance with the law n°036-2015/CNT of June 26, 2015, relating to the Mining Code of Burkina Faso and its amending law n°012-2023/ALT of July 25, 2023.

I.3. UNDER THE MINISTRY OF ENVIRONMENT, WATER, AND SANITATION

The Council adopted two (02) decrees.

The first decree adopts the Master Plan for the development and management of water (SDAGE) of the area of competence of the Nakanbé Water Agency (EC-AEN).

The vision of the SDAGE of the EC-AEN by 2035 is to “Make good governance and efficient use of water resources the main pillars to effectively support the socio-economic and environmental development of the EC-AEN by 2035.”

To achieve this, the SDAGE of the EC-AEN sets the following specific objectives:

  • to gradually mobilize approximately 2.7 billion m3 of surface water and 120 million m3 of groundwater by 2035 to achieve the growth objectives of the EC-AEN;
  • to ensure full access to basic living conditions such as energy, safe drinking water, and sanitation for the population of the EC-AEN by 2035;
  • to ensure food security and nutritional balance for the population of urban and rural areas of the EC-AEN by 2035, while supporting the development of value-added and job-creating sectors;
  • to support water governance based on knowledge and mastery of water resources management.

The adoption of this decree allows our country to have an important instrument for implementing the Territorial Development Policy in its “water resources and aquatic ecosystems” component at the level of the Nakanbé’s area of competence.

The second decree approves the statutes of the National Agency for Environmental Assessments (ANEVE).

This decree is a revision of decree n°2020-664/PRES/PM/MEEVCC/MINEFID of July 28, 2020, approving the statutes of the National Agency for Environmental Assessments.

As major innovations, the following are noted, among others:

  • the harmonization of the mission of ANEVE with the organization chart of the ministry;
  • the review of the attributions of ANEVE by taking into account the development and implementation of the National Strategy for Environmental and Social Assessments, the reformulation of attributions related to environmental inspection and accreditation of consultants.

The adoption of this decree allows the National Agency for Environmental Assessments to effectively fulfill its missions, in accordance with the provisions of decree n°2014-613/PRES/PM/MEF of July 24, 2014, establishing the general status of public administrative establishments of the State.

II. ORAL COMMUNICATIONS

II.1. The Minister of Territorial Administration, Decentralization, and Security made a communication to the Council regarding the implementation of corrective fire safety measures in vital interests establishments in Burkina Faso.

The analysis of the causes and circumstances of certain fires in our country reveals that their origins are due to material failures, particularly electrical, as well as the insufficient implementation of prevention and prediction measures. The development and spread of fires are mainly linked to the lack of water points, fire safety services, and first aid equipment.

To address this situation, the following measures are necessary:

  • identify the establishments concerned in each ministry;
  • conduct a fire safety audit of these establishments, whether public or private, accompanied by corrective measures to be applied.

In addition, ministries should take into account fire safety requirements in their construction or investment projects, as indicated by regulations. State lease agreements should also systematically incorporate the opinions of the National Fire Brigade regarding compliance with fire regulations.

II.2. The Minister of Foreign Affairs, Regional Cooperation, and Burkinabè Abroad made a communication to the Council on the report of a Burkinabè delegation’s friendship and working visit to Tehran, Islamic Republic of Iran, from September 2 to 4, 2023.

This friendship and working visit aimed to strengthen the Ouagadougou-Tehran axis.

During this visit, the Burkinabè delegation presented to the highest Iranian authorities the security and humanitarian situation in our country and advocated for comprehensive support. In response to this plea, the Iranian side pledged to enhance its cooperation with our country in the fight against terrorism. The two countries also committed to further strengthening their cooperation in the health, energy, and trade sectors.

II.3. The Minister of Agriculture, Animal and Fisheries Resources made a communication to the Council on the debts of the National Land Development and Rural Equipment Company (SONATER) related to the sale of agricultural equipment.

As part of the promotion of mechanization in Burkina Faso, the State established in 2008 the Agricultural Mechanization and Support to the Hydraulic Sector Development Project (PDMA-SSH) implemented by SONATER. The credit sales of agricultural equipment to public structures, professional organizations, and individuals have generated debts for SONATER, which is facing significant challenges in their recovery.

The recorded credit sales under the PDMA-SSH amount to 4,124,899,039 XOF for debts amounting to 497,897,497 XOF. As for the amount of debts related to the sale of agricultural equipment by SONATER, it amounts to 3,563,484,600 XOF. In addition to customer debts, State debts must be added, which represent the amount of subsidies for the sale of agricultural equipment from operations in 2019 and 2021. This cumulative amount totals 7,536,988,665 XOF.

Faced with this situation, SONATER has implemented debt recovery actions. Despite these efforts, SONATER’s debts remain substantial, totaling 11,598,370,762 XOF, of which 4,061,382,097 XOF is for customer debts and 7,536,988,665 XOF is for State subsidies.

The Council instructed the ministers responsible for the matter to take vigorous measures to fully recover the various debts within the shortest possible time.

II.4. The Minister of Solidarity, Humanitarian Action, National Reconciliation, Gender, and Family made a communication to the Council relating to a government visit to Burkinabè refugees in neighboring countries due to the security crisis.

Government missions will visit Ghana, Togo, Benin, Côte d’Ivoire, and Mali. Their objective is to reassure our fellow countrymen who are refugees about the efforts made by the Government for their return and resettlement in their places of origin.

II.5. The Minister of Environment, Water, and Sanitation made a communication to the Council regarding Burkina Faso’s participation in the 28th Conference of the Parties (COP 28) to the United Nations Framework Convention on Climate Change.

The COP 28, scheduled from November 30 to December 12, 2023, in Dubai, United Arab Emirates, is an opportunity to accelerate the energy transition to build the future global energy system.

II.6. The Minister of Communication, Culture, Arts, and Tourism made a communication to the Council on the participation of Burkina Faso in the 45th session of the UNESCO World Heritage Committee in Riyadh, Kingdom of Saudi Arabia, from September 10 to 25, 2023.

During this session, the committee reviewed proposals for the inscription of cultural properties on the World Heritage List and the state of conservation of properties inscribed on the List of World Heritage in Danger. Under the leadership of the Minister of Communication, Culture, Arts, and Tourism, the Burkinabè delegation held meetings with other delegations on the sidelines of the work of this 45th session. These meetings allowed the Head of the Burkinabè delegation to present major projects in Burkina Faso and seek support from partners for their realization. These include the inscription of eleven (11) Burkinabè cultural properties on the international list of strengthened protection of the 1954 UNESCO Convention for the Protection of Cultural Property in the Event of Armed Conflict and the proposed inscription of the Tiébélé Royal Court on the World Heritage List in 2024.

The Council has adopted two (02) decrees.

The first decree renews the mandate of Monsieur Jean Michel KIEMTORE, Mle 111 314 A, Economic Affairs Counselor, State Representative Administrator, under the Ministry of Industrial Development, Trade, Crafts, and Small and Medium-Sized Enterprises, on the Board of Directors of the National Food Security Stock Management Company (SONAGESS) for a final period of three (03) years.

The second decree appoints the following individuals as Administrators on the Board of Directors of the Integrated Development Company of the Sourou Valley Growth Pole (SOUROUPOLE_SEM) for an initial term of three (03) years.

The second decree renews the mandate of Monsieur Maurice SAWADOGO, Mle 95 141 Z, Certified Primary School Teacher, Administrator representing Administrative, Technical, Manual, and Support Staff (ATOS) on the Board of Directors of the Polytechnic School of Ouagadougou (EPO) for a final period of three (03) years.

The third decree appoints Monsieur Barthélémy KAGAMBEGA, Trainee Professor of General Education Colleges, Administrator representing trainees on the Board of Directors of the National Teacher Training College (ENS) for the duration of his term as General Delegate.

The fourth decree appoints Monsieur Hama Mamadou DICKO, Mle 57 288 H, Teaching and Research Staff, Administrator representing the State, under the Ministry of Higher Education, Research, and Innovation, on the Board of Directors of the National Biosafety Agency (ANB) for an initial term of three (03) years.

The fifth decree appoints Monsieur Hama Mamadou DICKO, Mle 57 288 H, Teaching and Research Staff, as the Chairman of the Board of Directors of the National Biosafety Agency (ANB) for an initial term of three (03) years.

C. MINISTRY OF SPORTS, YOUTH, AND EMPLOYMENT

The Council has adopted a decree appointing Mr. Nicolas Wêndwaoga OUEDRAOGO, ID 117 238 N, Professor of Physical Education and Sports, Administrator representing the State, on behalf of the Ministry of Sports, Youth, and Employment, to the Board of Directors of the National Fund for the Promotion of Sport and Recreation (FNPSL) for a first term of three (03) years, replacing Madame Colette OUEDRAOGO.

D. MINISTRY OF TRANSPORT, URBAN MOBILITY, AND ROAD SAFETY

The decree has been issued appointing Mr. Itugnine Séraphin SOMDA, Registration Number 101 589 M, as the State representative on the Board of Directors of the Burkina Railway Asset Management Company (SOPAFER-B) for a first term of three (03) years. Mr. Somda is an Inspector of Secondary Education.
