The ordinary Council of Ministers’ meeting of the Burkinabe government was held on Wednesday, November 22, 2023, under the chairmanship of His Excellency Captain Ibrahim TRAORE, President of the Transition, President of the Council of Ministers. Find below the complete decisions taken.
𝐈. 𝐃𝐄𝐂𝐈𝐒𝐈𝐎𝐍𝐒
I.1. UNDER THE MINISTRY OF DIGITAL TRANSITION, POSTS, AND ELECTRONIC COMMUNICATIONS
The Council adopted two (02) reports.
The first report relates to a draft decree defining the obligations of electronic communications service operators regarding the retention of traffic and location data.
This decree is a revision of the decree n°2013-149/PRES/PM/MDENP/MEF/MJ of March 21, 2013, defining the obligations of electronic communications service operators regarding the retention of traffic and location data. It aims to provide investigators with a legal tool by regulating the storage and access to navigation data in order to contribute to the fight against cybercrime and cyberterrorism in Burkina Faso.
The innovations of this decree include:
- the obligation for electronic communications service operators to retain a certain amount of information for the purpose of research, detection, and prosecution of criminal offenses;
- the establishment of a response deadline for operators to requests, which should now be processed within a maximum of seventy-two (72) hours;
- clarification of the information elements allowing better identification and location of users.
The adoption of this decree allows for the establishment of a transparent legal framework to govern interactions between security and intelligence services and electronic communications service operators, in accordance with the provisions of the law n°061-2008/AN of November 27, 2008, regulating networks and electronic communications services in Burkina Faso, along with its amendments.
The second report concerns a draft law on the security of information systems in Burkina Faso.
This draft law will enable our country to have a legal and regulatory framework for better protection of information systems in order to reduce the vulnerability of our administrations and economic development units.
The Council agreed to transmit the draft law to the Legislative Assembly of the Transition.
I.2. UNDER THE MINISTRY OF SPORTS, YOUTH, AND EMPLOYMENT
The Council adopted a decree approving the specific statutes of the “Faso Kuna Wili (FKW)” Fund.
The adoption of this decree allows the “Faso Kuna Wili (FKW)” Fund to establish regulatory texts in order to effectively fulfill its missions, in accordance with the provisions of the decree n°2014-610/PRES/PM/MEF of July 24, 2014, establishing the general status of national funds.
I.3. UNDER THE MINISTRY OF COMMUNICATION, CULTURE, ARTS, AND TOURISM
The Council adopted four (04) decrees.
The first decree establishes the interministerial committee for the Burkinabe Tourism Satellite Account.
The evolution of the global, regional, and national context in recent years has led many countries to review their strategies for tourism development. To align with this dynamic, Burkina Faso has enacted a new law for the development of tourism activities in 2021.
The interministerial committee for the Burkinabe Tourism Satellite Account is responsible for compiling statistical data related to national tourism activities in order to operationalize the Burkinabe Tourism Satellite Account.
The adoption of this decree allows for the establishment of the interministerial committee for the Burkinabe Tourism Satellite Account, in accordance with the provisions of the law n°011-2021/AN of April 16, 2021, outlining the orientation of tourism in Burkina Faso.
The second decree regulates the control of tourism company activities.
This decree aims to strengthen regulations regarding the control of tourism companies in order to improve the quality of goods and services provided by these companies.
The innovations include:
- the control of tourism companies, which now takes place at any time, before the actual start of the company’s operations (compliance control of the location site), during the execution of works (compliance control of the achievements with the project submitted to the Ministry responsible for tourism), and during the operation of the company (standards compliance control);
- strengthening the powers of agents responsible for the control of tourism companies.
The adoption of this decree provides better supervision of tourism companies, in accordance with the provisions of the law n°011-2021/AN of April 16, 2021, outlining the orientation of tourism in Burkina Faso.
The third decree concerns the classification and regulation of the development and operation of tourist sites.
This decree aims to improve and streamline the business climate in the management of tourist sites, taking into account scientific, technical, and technological developments.
The major innovations include:
- the establishment of a national list of tourist sites;
- the establishment of an operating license for private tourist sites;
- strengthening the protection of public sites through the establishment of specifications for their management.
The adoption of this decree allows our country to have a more favorable legal framework for the development of a dynamic and competitive tourism industry, in accordance with the provisions of the law n°011-2021/AN of April 16, 2021, outlining the orientation of tourism in Burkina Faso.
The fourth decree regulates the profession of tourist guide.
This decree aims to professionalize tourist guides and harmonize national legislation with the provisions of the West African Economic and Monetary Union (UEMOA) regarding the exercise of the profession of tourist guide.
The major innovations include:
- the definition of a new category of tourist guide, namely the community guide;
- relaxation of the conditions for obtaining the professional tourist guide card;
- the establishment of new sources of revenue for the state budget.
The adoption of this decree provides our country with an appropriate regulatory framework for the exercise of the tourist guide profession, in accordance with the provisions of the law n°011-2021/AN of April 16, 2021, outlining the orientation of tourism in Burkina Faso.
𝐈𝐈. 𝐂𝐎𝐌𝐌𝐔𝐍𝐈𝐂𝐀𝐓𝐈𝐎𝐍𝐒 𝐎𝐅𝐅𝐈𝐂𝐈𝐀𝐋𝐒
II.1. The Minister of Solidarity, Humanitarian Action, National Reconciliation, Gender, and the Family made a communication to the Council regarding the implementation of the compensation process for victims and beneficiaries of victims of various sociopolitical crises.
The Ministry of National Reconciliation established on February 28, 2023, by joint order n°2023-003/MSAHRNGF/MEFP of February 28, 2023, an interministerial committee for the compensation of victims and beneficiaries of victims of various sociopolitical crises in Burkina Faso. The committee was tasked with analyzing and processing the files of different victims of sociopolitical crises from 1960 to the present day. After several meetings with different categories of victims, the committee encountered significant difficulties that hinder the progress of the compensation process. These difficulties include, among others, the lack of certain documents in the files due to the elapsed time and the non-inclusion of certain categories of victims in the joint order n°2023-003/MSAHRNGF/MEFP of February 28, 2023.
Given these difficulties, the committee has developed initiatives and identified possible options to ensure the compensation of victims and beneficiaries of victims of various sociopolitical crises.
II.2. The Minister of Economy, Finance, and Prospective made a presentation to the Council on the second edition of the National Conference of Territories, held on October 26, 2023.
This second edition was held under the theme “Territories and Challenges of Food Self-Sufficiency in a context of high pressure on land and climate change in Burkina Faso.”
The overall objective of the second edition of the National Conference of Territories was to enable development actors to exchange views on the contribution of territories to achieving food self-sufficiency in Burkina Faso.
II.3. The Minister of Higher Education, Research, and Innovation made a communication to the Council regarding the inauguration ceremony of the unique academic gown in Higher Education and Research Institutions.
This ceremony will take place on November 28, 2023, at the Joseph KI-ZERBO University (UJKZ), under the theme “The Role of Higher Education and Research Institutions in Building Identity and Affirming Sovereignty for Endogenous Development in Burkina Faso.”
During this ceremony, 583 professor-researchers, university hospital professors, and researchers will receive their academic gowns, which are entirely made of Faso Danfani fabric.
II.4. The Minister of Environment, Water, and Sanitation made a communication to the Council regarding the organization of the 2nd edition of the National Academy of Green Economy in Burkina Faso from December 19 to 21, 2023.
This edition is held under the theme “Green Economy: Resilience Factor for Communities for Sustainable Peace in a context of Climate Change and Security Challenge.”
The National Academy of Green Economy is a capacity-building framework for national decision-makers, technical staff, practitioners, and other actors from the public and private sectors on concepts and issues related to the green economy.
II.5. The Minister of Urbanism, Land Affairs, and Housing made a communication to the Council regarding the situation of cities and localities in Burkina Faso in the security and humanitarian context.
Cities and localities facing significant security challenges are experiencing unexpected population pressure. Based on the observations made regarding the state of these cities and localities accommodating Internally Displaced Persons (IDPs), there is accelerated urbanization due to the security crisis. This urbanization rate has exceptionally increased from 2019 to 2023, with a growth of 9.3 points in less than four (04) years, without real investment support for the strengthening of urban services.
As for urban hierarchy, it is also experiencing a disruption due to the reception of significant numbers of IDPs in cities and certain localities that were not recognized as cities until now.
The demographic analysis of cities, regional capitals facing significant security challenges such as Dori, Dédougou, Kaya, Fada N’Gourma, and Ouahigouya, in relation to the demographic projections of their Master Plans for Development and Urban Planning (SDAU) adopted between 2013 and 2014 by the Burkinabe Government reveals a pronounced discrepancy in demographic and spatial terms.
Based on demographic projection assumptions, the current population of these five (05) cities was not expected until 2030, but these cities have seen their populations double, or even more, since 2019.
Since the projections were made based on a pre-existing security and humanitarian crisis in our country, the disparities between the SDAU projections and reality compromise the implementation of the initially planned development options.
The Council instructed the ministers in charge of the issue to establish an interministerial committee to develop a strategic plan for urban reconfiguration.

The Council adopted a decree appointing Mr. Donald OUEDRAOGO, Registration No. 293 470 K, Studies and Analysis Advisor, Administrator representing the State, on behalf of the Ministry of Agriculture, Animal and Halieutic Resources, to the Board of Directors of the Burkinabe Agency for Standardization, Metrology, and Quality (ABNORM) for a first term of three (03) years, replacing Mrs. Ella Innocente Monier BOUDANE/TOE.
