The Tiens DS-COM case has taken a twist. During the hearing on Thursday, July 27, the judge in charge of the case sided with the special prosecutor and declared himself incompetent.
The individuals accused of conspiracy in the Tiens DS-COM case were present at the Court of Repression of Economic Offenses and Terrorism (CRIET) on Thursday, July 27, 2023. During the hearing on July 22, the special prosecutor of CRIET had requested the judge in charge of the case to declare himself incompetent.
In the hearing last Thursday, the judge followed the prosecution’s request and declared himself incompetent, thus opening the way for a new procedure. The case is now referred to the investigating commission of the specialized jurisdiction, despite the opposition of the lawyers of the defendants.
Placed in pretrial detention in July 2022, the defendants in this case had been tried for “fraud, money laundering, and solicitation of public savings.” During the trial, the Court decided on Tuesday, January 24, 2023, to acquit them completely. However, the special prosecutor of CRIET appealed the decision.
In May of this year, the ten defendants in the case were sentenced to 5 years in prison for “fraud and illegal practice in pharmacy.” This decision is currently under appeal.
