The Prosecutor of the Republic at the First Instance Court of Abomey-Calavi has reacted to the demolition of several houses in the Tankpè neighborhood. In a statement published on Monday, August 28, 2023, the magistrate clarified the case.

On Wednesday, August 23, several residents of Tankpè were left homeless, surprised by the ruthless demolition of their houses. Following this action that sparked outrage in public opinion, the Prosecutor of the Republic at the Abomey-Calavi Court, Aubert Kodjo, took a stand to clarify what had happened.

As an officer had told BENIN WEB TV on the day of the demolitions, Aubert Kodjo confirmed that it was the execution of a court decision. “Indeed, it is the execution of the authentic copy of the contradictory judgment No. 120/20 rendered by the second chamber of real estate property law of the Court of Appeal of Cotonou on August 11, 2020, in the matter of the heirs of the late BANKOLE Félix Médard, Rep/ BANKOLE Hospice Raoul Macaire C/AITCHEDJI Marcelline, and 12 others,” the Prosecutor specified.

Following the judgment, the Prosecutor learned that “the constructions concerned were identified and then listed, and the parties were informed. Instructions were given to the bailiff to favorably assess the case of the occupants who would present themselves to him within the framework of a peaceful execution. Despite these provisions, the occupants, in disregard of the procedure, refrained from complying.”

Police requested for the execution of the court decision In execution of the enforceable formula mentioned on the authentic copy, the Abomey-Calavi prosecutor’s office said it instructed the police to “assist in the execution of the court decision.” Furthermore, the Prosecutor invites other occupants affected by the decision to conform to the real estate and land code in the Republic of Benin.
